Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The case originates in a erroneous deportation to El Salvador in March, which the government later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was detained in immigration detention.

In her order, the court pointed out that the authorities does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
