Andrej Babiš, the self-proclaimed billionaire that secured victory in the recent Czech election, has declined to offload his extensive business interests, while asserting he will address a conflict of interest that might prevent him from assuming the position of head of government.

Stance on Corporate Empire

Babiš, whose ANO party came first in the October election but lacked a majority in parliament, stated in a online statement that he will not sell his Agrofert conglomerate, which is active in agriculture, food production, and chemicals.

“I have consistently said I will never sell Agrofert. I have repeatedly stated I will resolve the conflict of interest in accordance with national and European laws,” the billionaire commented. “This is not like selling a roll in a bakery.”

President's Requirement

The Czech president, Petr Pavel, stated that the elderly political figure must publicly explain how he will remove conflicts of interest arising from his business activities before assuming the role of premier.

The national charter “clearly mandates the president to consider the potential occurrence of a conflict of interest and the ways to address it” when appointing government ministers, the presidential administration noted.

The head of state “expects clarity in what precise manner Andrej Babiš will fulfil his statutory duties”, the statement said, noting that Pavel was ready to appoint Babiš as premier “immediately” once the matter was resolved.

Business Operations and Regulatory Issues

Babiš's numerous firms, primarily under the Agrofert umbrella, function in the nation and other regional states, benefiting from substantial funds in domestic and European farming and other subsidies, as well as government deals.

Under national legislation, cabinet members are barred from receiving public aid or agreements. The ethics watchdog Transparency International has stated that to prevent a ethical breach, Babiš must either sell, refuse public contracts, or stay out of government.

Previous Term and Present Intentions

Babiš affirmed he would “abide by the regulations” if selected as premier, but did not want to detail how in advance because the issue was “an extremely sensitive and personal matter for me, and journalists will always question me anyway”.

During his first term as prime minister, from 2017 to 2021, Babiš encountered multiple court cases and an European inquiry over possible conflicts of interest. He temporarily moved his holdings into trust funds, while keeping certain control over them.

A court and the EU executive both ruled that this did not suffice. Babiš stated recently that he was once more the sole owner of Agrofert and maintained he was “taking steps” to prevent a ethical problem, but refused to disclose details.

Coalition Agreement and International Consequences

The wealthy politician has signed a governing pact with two rightwing fringe parties, the far-right, Russia-friendly SPD, which has advocated a public vote on exiting the EU, and the Motorists for Themselves, which has mainly opposed the EU’s environmental policy.

The incoming administration, if confirmed, is expected to strengthen the populist movement in central and eastern Europe and might challenge backing from Western nations for Ukraine – although Babiš has contacted Ukraine’s president, Volodymyr Zelenskyy, to assure him of Czech support.

Pavel, who as head of state has a role for international relations, also demanded that the government agenda add a statement on the government’s position on Russia’s war in Ukraine, with a commitment to meeting Nato obligations.

The president has earlier stated he would not endorse any ministerial nominees who might question the Czech Republic’s international alliances, a requirement that the far-right SPD has indicated it will meet by nominating independent technocrats.
